LATE FEE POLICY
Marie’ Vineyard Home Owners Association (MV HOA) is operated by volunteers. It is incumbent on the property owner to pay their assessment promptly. All payments for the annual HOA assessment are due by January 5th of each year.
The MV HOA Board shall use its authority under RCW 64.38.020(11) “…levy reasonable fines in accordance with a previously established schedule adopted by the board of directors and furnished to the owners for violation of the bylaws, rules and regulations of the association.” The Board has established a late fee of $100 per year plus 12% interest for any assessment that is not received by the MV HOA Treasurer by February 4th of each year. The Board shall use at its discretion any means to collect said delinquent charges of the assessment plus late fees, (or late fees when a late payment is submitted without late fees) plus legal costs plus collection costs. The Board shall have the authority to adjust the late fee yearly. The Board may file a lien against the property. The Association may also bring an action at law against the Lot Owner personally obligated to pay a delinquent assessment (which may include late fees, legal fees and collection costs) or foreclose the lien.
Home owners may file a written request for an extension of payment for the current year. The request must delineate when payment will be made. It must be submitted by January 5th of that year to the official mailing address (2020 Craig Rd SE Olympia, WA 98501) of the HOA. The Board of the HOA will respond within 30 days and may accept or reject the request. If the payment is not received by the MV HOA Treasurer in accordance with the HOA approved extension, the Board shall have authority to collect said charges and costs as detailed above.
